BUSZ – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the BUSZ mobile application (“App”). The App is developed and operated by BUSZ Transit Solutions (“we,” “our,” or “us”), a brand of MyTuitioninnPro Education Pvt. Ltd. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.

Eligibility

The App is intended for a general audience. If you are a minor under applicable law, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Licence to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App for your personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted to you.

The Service

BUSZ provides bus tracking, route, schedule, and related transit information for Kerala. The App is provided free of charge and is supported by advertising. We may add, change, suspend, or remove features of the App at any time without notice.

      Important – accuracy of transit information: Bus locations, arrival and
      departure times, ETAs, routes, and service information are provided on a best-effort basis and
      may be estimated, delayed, incomplete, or inaccurate. They depend on third-party data,
      network conditions, GPS availability, and operator schedules. You should not rely
      solely on the App for time-critical decisions. We are not responsible for missed
      buses, connections, or any loss arising from reliance on the information provided.
    

Acceptable Use

When using the App, you agree that you will not:

violate any applicable laws or regulations;
use the App to distribute harmful, unlawful, or malicious content;
attempt to gain unauthorized access to any part of the App or its systems;
interfere with, disrupt, or overburden the App, our servers, or networks;
reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by law; or
copy, modify, distribute, or create derivative works from the App without our prior written consent.

Intellectual Property

All content, features, and functionality of the App — including text, graphics, logos, icons, and software — are the exclusive property of BUSZ Transit Solutions or its licensors and are protected by applicable intellectual property laws. The BUSZ name and logo are our trademarks and may not be used without our prior written permission.

Feedback

If you send us suggestions or feedback about the App, you grant us a perpetual, royalty-free right to use it without restriction or obligation to you.

Third-Party Services

The App integrates third-party services, including Google AdMob (advertising), Firebase (analytics and push notifications), and device map providers (such as Apple Maps or Google Maps). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services, and you use them at your own risk. Please also review our Privacy Policy.

Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, error-free, or that transit information will be accurate or reliable.

Limitation of Liability

To the maximum extent permitted by law, BUSZ Transit Solutions and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the App, even if advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless BUSZ Transit Solutions and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms or applicable law.

Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in activities that may harm the App or other users. You may stop using the App at any time by uninstalling it.

App Store Terms

If you download the App from the Apple App Store or Google Play, you also agree to the applicable store's terms. You acknowledge that these Terms are between you and us (not with Apple or Google), and that the app stores are not responsible for the App or its support. To the extent required by Apple, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the App after changes take effect means you accept the revised Terms.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. You agree that the courts located in Kozhikode, Kerala, India shall have exclusive jurisdiction over any dispute arising out of or relating to the App or these Terms.

Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
